Premarital and Post Marital Agreements

With over 35 years of experience, we guide clients through crafting strong pre-marital and post-marital agreements and navigating challenges to existing agreements in court. This extensive experience allows us to tailor each agreement to our clients' unique circumstances and objectively assess whether a marital agreement is the most beneficial course of action for a given situation.


The pre-marital (or pre-nuptial) agreement is signed before the wedding, while the post-marital agreement is signed after the wedding.


Other than timing, the biggest difference between the two agreements is that there is a fiduciary duty between spouses, which means each spouse has a duty to treat their spouse  with honesty, full disclosure, and in the manner you would want to be treated if the circumstances were reversed. There is no fiduciary duty between people about to marry, unless other facts create a fiduciary duty.


In both cases, however, it is strongly recommended that each party retain separate counsel.
